Terms of Service

1. Acceptance of Terms

By accessing or using ShowBuilder ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Brandon Brown ("we," "us," or "our"), the operator of ShowBuilder.

2. Description of Service

ShowBuilder is a web-based band management platform that provides tools for managing band members, setlists, gigs, songs, stage plots, and related content. The Service is available at showbuilder.app and through any associated domains.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

To access certain features, you must create an account. You agree to provide accurate and complete information during registration, keep your login credentials confidential, notify us immediately of any unauthorized use of your account at moozbooking@gmail.com, and take responsibility for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Plans and Billing

ShowBuilder offers the following plans:

• Free Plan: Limited features at no cost. The Free plan will be discontinued on July 1, 2026. After that date, a paid plan is required to continue using the Service.
• Pro Plan: $15.00 per month
• Manager Plan: $35.00 per month

Subscriptions are billed monthly and renew automatically unless cancelled. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through the billing portal in your account settings.

6. Free Plan Discontinuation

The Free plan will no longer be available after July 1, 2026. Users on the Free plan will need to upgrade to a paid plan to retain access to the Service after that date. We will provide advance notice within the application.

7. User Content

You retain ownership of all content you upload or create within the Service. By using the Service, you grant us a limited, non-exclusive license to store and display your content solely for the purpose of operating the Service. You are solely responsible for your content and agree not to upload anything that infringes third-party rights, is unlawful or harmful, or contains malware.

8. Prohibited Use

You agree not to use the Service for any unlawful purpose, attempt to gain unauthorized access to any part of the Service, reverse engineer or decompile the Service, use automated tools to scrape or extract data, or resell the Service without written permission.

9. Intellectual Property

All content, design, code, and materials that make up the Service (excluding your content) are owned by Brandon Brown and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without prior written consent.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may request a data export within 30 days by contacting moozbooking@gmail.com.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.

12. Limitation of Liability

To the fullest extent permitted by law, Brandon Brown shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction in the United States.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance.
